Permitted third attempt to retake OSCE

Examination

 

Year 4 medical student (our client’) on the MBBS programme failed the resit for the OSCE Examination. Our client was deregistered from the MBBS programme. RT Coopers were instructed to draft an appeal to the MBBS Part 4 Subject Examination Board to allow our client the opportunity to retake Year 4 and a third attempt at the OSCE Examination as a ‘first take’. 

 

Introduction

For the MBBS programme a third exceptional attempt was only permitted at the discretion of the Subject Examination Board or Degree Examination Board and, if permitted, required our client to retake the academic year.

 

Grounds

RT Coopers drafted the appeal on grounds of procedural error and exceptional circumstances.

  • Our client was sent the mark sheets for the OSCE Examination with no input from the Academic Year Tutor (AYT).
  • Our client was never informed of the actual stations failed and the reasons why. This information was needed to successfully pass the OSCE Examination.
  • Our client had to rely on the feedback from the OSCE mark sheets and had to figure out how to interpret the marks and the feedback on the mark sheets.
  • Other students were informed about their mistakes and which stations they had failed.
  • Furthermore, the AYT did not inform our client which topics would be examined although other AYTs provided their students with this information. As medical students in this cohort  were informed about their mistakes and which stations they failed, they knew what possible steps to take to avoid failing the OSCE Examination.

 

In addition, our client had Extenuating Circumstances, although our client did not submit an EC form to cover these Extenuating Circumstances. Some of the Extenuating Circumstances include:

  • Little preparation time.
  • Adopted a method of trying to cover as much ground as possible in the short period which did not pay off.
  • Gap in knowledge.
  • Needed more practice.

 

Outcome

Our client’s appeal was upheld and was given the opportunity to retake the OSCE Examination in the following year.

 

Our client is now a medical doctor.
