General Pharmaceutical Council (‘GPhC’) pre-registration assessment – MPharm student sat and failed three attempts of the GPhC pre-registration assessment. With the initial information/evidence presented to RT Coopers in support of the appeal, there was only a slim chance of success, which was conveyed to the MPharm student. Second year medical referred to Fitness to Practise (FTP) Panel. The student was asked by University to initially attend an advisory meeting following serious concerns raised by fellow medical students – concerns were about events that allegedly happened during COVID 19, including sexual misconduct. Medical student had no recollection of these alleged events. The allegations were brought over one year later. RT Coopers advised and assisted student to ensure that the allegations did not go beyond the advisory stage as the student was due to appear before an FTP advisory panel constituted for stage 1 investigation. Food Supplements: How to ensure Compliance of Food Supplements under UK Law
In order to manufacture, process, distribute, use, sell or import food supplements in the United Kingdom (“UK”), a manufacturer, importer or distributor of food supplements must be compliant under the law, writes Dr Rosanna Cooper. In this article we explore the regulation of food supplements in the UK.
1. Introduction
The industry sector for food supplements is wide and varied spanning across the whole of Great Britain (‘GB’), which means that the manufacture, process, distribution, use, sale or import of food supplements are subject to national law.
2. The regulation of the sale of food supplements
Food supplements are sold 'in dose' form as pills, tablets, capsules or liquids and may be used to balance certain nutritional deficiencies or maintain an adequate intake of certain nutrients. The Annexes of the EU Food Supplements Directive 2002/46 (“The Directive”) as amended have been adopted into UK laws and along with other Regulations made in each part of the UK, they aim to ensure safe use of food supplements.

UK Biocidal Regulation: Treated Articles
The Biocidal Product Regulation EU 528/2012 (“EU BPR”) has been copied into GB law and amended accordingly. Therefore, most aspects of EU BPR have been adopted into the new UK Biocidal Products Regulation (‘UK BPR’), which came into force on 31 December 2020.
Biocidal Products
1. Introduction
The EU BPR came into effect on 1 September 2013. It replaced the Biocidal Directive 98/8/EC. The EU BPR was binding in its entirety and directly applicable in all Member States of the European Union. The EU BPR concerned companies making biocidal products available on the EU market and the placing on the market of treated articles. It also dealt with the use of the active substances contained in biocidal products to protect humans, animals, materials or articles against harmful organisms, such as pests or bacteria, writes Dr Rosanna Cooper.
2. Active Substance(s)
The active substance in a biocidal product must gain authorisation from the Health and Safety Executive (“HSE”).

There is an obligation on a Marketing Authorisation Holder (MAH) to ensure that the MAH is compliant with current legislation otherwise the Marketing Authorisation could be withdrawn.

BREXIT AGREEMENT By RT Coopers Solicitors
From 01 January 2021, the UK and European Union Trade and Cooperation Agreement (‘Agreement’) came into effect. Due to the parties reaching agreement in late December 2020, the European Commission proposes to apply the Agreement on a provisional basis, for a limited period until 28 February 2021.
The UK leaves the EU Single Market and Customs Union, all EU policies and international agreements will not be applicable to the UK. The free movement of persons, goods, services and capital between the UK and the EU will cease.
In this regard, the EU and the UK will form two separate markets and distinct regulatory and legal regimes. This separation creates barriers to trade in goods and services. This article is written by specialist lawyers at RT Coopers Solicitors.
We have only discussed the areas in the Agreement that are applicable to our clients in this article:
i. One of the key areas is the establishment of a partnership for the security of citizens of the UK and EU. There is a new economic and social partnership between the UK and EU
ii. The Agreement deals with goods and services including, but not limited to, intellectual property, legal services, financial services, fisheries, energy and regulatory affairs, data protection and social security coordination.
iii. There are specific provisions addressing origin of goods that will have to be complied with. Provided that the rules of origin are adhered to, there will be no tariffs or quotas on the transit of goods between the EU and UK.
iv. With regard to social security coordination, the Agreement seeks to ensure a number of rights of EU citizens and UK nationals.
v. The Agreement allows the UK to continue to participate in a number of flagship EU programmes for the period 2021-2027.
vi. Under the Agreement, there is a new partnership established for law enforcement and judicial cooperation in criminal and civil law matters.
vii. A framework to give legal certainty to businesses, consumers and citizens.
viii. A Joint Partnership Council will be established to ensure compliance.
ix. Under the Agreement, there is binding enforcement and dispute settlement mechanisms which will ensure that rights of businesses, consumers and individuals are respected.
